About these terms
These Terms & Conditions ("Terms") apply to your use of the Core Driven Industries website, your enquiries, quotes, online orders, purchases, product requests and interactions with Core Driven Industries ("CDI", "we", "us", "our").
By using our website, submitting an enquiry, requesting a quote, placing an order or purchasing from CDI, you agree to these Terms.
These Terms are intended to operate in Australia and are subject to applicable Australian laws, including the Australian Consumer Law where it applies.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law.
Using our website
You may use our website for personal, business or commercial purchasing purposes, including browsing products, submitting enquiries, requesting quotes and placing orders where available.
You must not use our website in a way that:
- breaches any applicable law
- interferes with the operation or security of the website
- attempts to gain unauthorised access to our systems
- copies, scrapes, mirrors or extracts website content for commercial use without our written permission
- misuses enquiry forms, checkout functions or communication channels
We may update, restrict, suspend or remove parts of the website at any time where reasonably necessary.
Product information and website content
We aim to provide accurate and helpful product information. However, product descriptions, specifications, images, renders, vehicle examples, diagrams, measurements and website content are provided for general guidance only.
Actual product appearance, fitment, finish, configuration and availability may vary depending on vehicle model, year, cab type, chassis, selected options, production batch, material availability, installation method and other practical factors.
Images of vehicles, trays, canopies, service bodies, toolboxes, accessories or completed builds may show optional extras, custom work, previous versions, promotional examples or configurations that are not included in the base product price.
Colours shown online, in photos, renders, samples or colour charts are indicative only and may vary due to lighting, screen settings, coating batches and manufacturing processes.
We may update product information, specifications, pricing, availability or website content at any time without prior notice.
Enquiries, quotes and vehicle information
Some CDI products and packages may require an enquiry, written quote or further discussion before purchase due to fitment, freight, installation, configuration or vehicle-specific requirements.
This may include trays, canopies, service bodies, vehicle-specific packages, custom products, made-to-order products and selected add-ons.
Providing accurate vehicle and fitment information helps us assess suitability, prepare quotes and respond more efficiently. This may include vehicle make, model, year, cab type, chassis details, tray length, existing modifications, intended use, photos, measurements or other relevant information.
Where information provided by a customer is inaccurate, incomplete or later changes, this may affect pricing, compatibility, delivery, installation, lead time or product suitability.
Any quote, recommendation or fitment advice we provide is based on the information available to us at the time. Unless expressly stated otherwise in writing, quotes are not final orders until accepted and confirmed.
Online orders and vehicle-specific products
Some general accessories may be available for direct purchase through our website using Shopify checkout.
Other products, including vehicle-specific add-ons, brackets, wiring components, fitment kits, radar brackets, camera-related parts, installation components or compatibility-dependent accessories, may only be available as part of a compatible main product, package or written quote.
We reserve the right to cancel, reject or contact you about an online order where:
- the product appears unsuitable for the vehicle or application
- required fitment information is missing
- the product is unavailable
- freight or installation needs to be confirmed
- a pricing or listing error has occurred
- the order appears fraudulent, incomplete or inconsistent with these Terms
If we cancel an order that has already been paid, we will provide an appropriate refund for the cancelled item, subject to applicable law.
Pricing, GST and additional costs
All prices shown on our website are in Australian dollars and include GST unless stated otherwise.
Unless expressly stated on the product page, quote, invoice, promotion or package description, prices do not include:
- freight, courier or delivery charges
- installation or fitment labour
- vehicle modification or preparation work
- camera, sensor, blind spot, lighting or wiring relocation
- optional extras, accessories or upgrades
- custom fabrication, special materials, special finishes or special colours
- removal or disposal of existing tubs, trays, accessories or components
- third-party inspection, engineering, certification or compliance costs where applicable
For larger products, bulk items or vehicle-specific packages, freight, installation and additional work may need to be quoted separately.
Promotional packages or fixed bundles may include selected extras, installation or freight only where this is clearly stated in writing.
Payment and written confirmation
For online orders, payment is processed through the available checkout methods on our website.
For quoted, custom, made-to-order or vehicle-specific products, we may require written confirmation before proceeding. Written confirmation may include approval by email, online form, signed document, invoice approval or other written communication.
For certain quoted, custom, special order or made-to-order products, payment terms may be confirmed separately in writing before the order proceeds.
Unless otherwise agreed in writing, supply-only products must be paid for in full before dispatch or collection.
For installation bookings, we may require a deposit or upfront payment before the booking is confirmed or work begins. Any remaining balance must be paid on completion of the installation, unless otherwise agreed in writing.
We may withhold dispatch, collection, installation, release of products or completion handover where required payments have not been made.
Custom, special order and made-to-order products
Some products may be custom, special order, made-to-order or vehicle-specific. This may include products involving special sizes, materials, finishes, colours, structures, configurations, fitment requirements or customer-approved specifications.
Where a customer approves a quote, specification, drawing, order summary or written confirmation, the customer is responsible for checking that the details are correct before approval.
Custom, special order and made-to-order products may involve committed materials, supplier costs, labour, design work, production planning, freight arrangements or manufacturing steps before completion.
Because of this, changes, cancellations or refunds may be limited once the order has progressed.
Changes, cancellations and change of mind
If you wish to change or cancel an order, you should contact us as soon as possible.
Whether a change or cancellation can be accepted will depend on the product type and the stage of the order.
We may consider factors including:
- whether the product is a standard stocked item
- whether the product is custom, made-to-order, special order or vehicle-specific
- whether work has already been performed
- whether materials, components or supplier costs have been committed
- whether fabrication, production, packing or freight has started
- whether the product has been installed, modified or used
- whether the product can reasonably be resold
Where reasonable, we may agree to a partial refund, credit, revised quote or order change. Any approved refund may be reduced by reasonable costs already incurred.
Change of mind cancellations are generally not available for custom, made-to-order, special order, vehicle-specific, installed, modified or used products, unless we agree otherwise or you are entitled to a remedy under the Australian Consumer Law.
Lead times and availability
Lead times, production timeframes, delivery estimates and installation timeframes are estimates only unless expressly confirmed otherwise in writing.
Product availability may vary depending on stock levels, supplier availability, production schedules, freight capacity, custom requirements and other practical factors.
If a material delay affects your order, we will contact you where appropriate and discuss available options, which may include continuing with the order, adjusting the order, choosing an alternative product or cancelling the affected item where applicable.
We will take reasonable steps to keep you informed of any material delay and to work with you on suitable next steps. To the extent permitted by law, CDI is not liable for indirect or consequential loss arising from delays, but this does not limit any rights you may have under the Australian Consumer Law.
Freight, delivery and collection
Freight and delivery for larger products, bulk items and vehicle-specific packages may require separate quotation.
This may include trays, canopies, service bodies, large toolboxes, package combinations and other bulky or heavy products.
Delivery timeframes are estimates only and may depend on freight providers, destination, product size, packaging requirements and availability.
Collection may be available by appointment where agreed.
Risk in products generally passes on delivery or collection, subject to your rights under the Australian Consumer Law and any applicable freight damage process.
If an item appears damaged on delivery, please take photos, keep the packaging where possible and contact us as soon as reasonably practicable, preferably within 48 hours where possible. This helps us assess the issue and work with freight providers where relevant.
Failure to notify us promptly may make freight claims harder to assess, but it does not limit any rights you may have under the Australian Consumer Law.
Installation, fitment and vehicle preparation
CDI may provide installation or fitment services for selected products. Customers may also choose to install products themselves or use a third party.
Installation and fitment may involve practical adjustment depending on the vehicle, product type and existing accessories. This may include drilling, trimming, bracket adjustment, wiring adjustment, camera relocation, reverse sensor relocation, blind spot system relocation, lighting changes or other fitment-related work.
Before installation, customers should remove personal belongings, tools, equipment and loose items from the vehicle, tray, tub, canopy, toolbox or installation area.
Where removal of an existing tub, tray, accessory or vehicle component is required, we will take reasonable care. However, older, modified, damaged, seized, corroded or tightly fitted components may carry additional risk during removal.
CDI is not responsible for damage, faults, fitment issues or failures caused by incorrect installation, unauthorised modification, misuse, third-party installation, customer-supplied components or work carried out by someone other than CDI, except to the extent required by law.
Returns, refunds and Australian Consumer Law
Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law.
You may be entitled to a repair, replacement, refund, cancellation or compensation where required by law, including where a product or service fails to meet a consumer guarantee.
For standard stocked accessories, we may consider a change of mind return where the item is unused, uninstalled, unopened, in original packaging, in resaleable condition and returned within a reasonable time. Approval is at our discretion unless required by law.
Change of mind returns are generally not available for:
- custom products
- made-to-order products
- special order products
- vehicle-specific products
- unlisted add-ons supplied as part of a package
- installed products
- modified products
- used products
- products damaged after delivery or collection
This does not limit your rights under the Australian Consumer Law.
Refunds, returns or remedies may be assessed based on the product type, condition, fault, use, installation history and applicable legal rights.
Warranty
Warranty terms may vary by product range and will be stated on the relevant product page, quote, invoice, warranty page or warranty documentation.
Warranty coverage may not apply where a problem is caused by:
- incorrect installation
- misuse, neglect or lack of maintenance
- unauthorised modification
- accident, impact or collision damage
- use outside the product's intended purpose
- improper loading or overloading
- third-party components or electrical faults
- normal wear and tear
- cosmetic deterioration that does not affect function
- corrosion caused by damage, exposure or poor maintenance
- customer-supplied parts or accessories
Nothing in our warranty terms excludes or limits your rights under the Australian Consumer Law.
Customer-supplied photos, feedback and information
If you provide photos, feedback, measurements, project details, fitment information or other materials to CDI, you confirm that you have the right to provide that material.
You allow us to use that material for the purpose of responding to your enquiry, preparing a quote, assessing fitment, managing your order, providing support, keeping business records or resolving a customer service issue.
We will seek appropriate permission before using customer-supplied photos or project content for public marketing where required.
You are responsible for ensuring that any information, photos or materials you provide are accurate, lawful and do not infringe the rights of another person.
Intellectual property
All content on our website and in our business materials is owned by or licensed to CDI unless stated otherwise.
This may include text, product descriptions, images, renders, videos, diagrams, page layouts, visual design, brand assets, logos, product information, technical content, fitment-related materials, engineering-related content and other website or marketing materials.
You must not copy, reproduce, scrape, mirror, adapt, republish, distribute, display or use our content for commercial purposes without our prior written permission, except where permitted by law.
You may download, print or save content for personal reference when considering CDI products or services, provided you do not remove ownership notices or use the content for competing commercial purposes.
Limitation of liability
To the extent permitted by law, CDI is not liable for indirect, incidental, special or consequential loss, loss of profit, loss of business opportunity, loss of use, vehicle downtime or other loss arising from your use of our website, products or services.
To the extent permitted by law, CDI is not responsible for loss, damage or issues caused by:
- inaccurate or incomplete information provided by a customer
- unsuitable product selection where relevant information was not provided
- incorrect installation or modification by a customer or third party
- use of a product outside its intended purpose
- failure to follow instructions, recommendations or maintenance guidance
- normal wear and tear
- events outside our reasonable control
Where our liability cannot be excluded under applicable law, our liability will be limited to the remedies permitted by law.
Nothing in this section limits your rights under the Australian Consumer Law.
Events outside our control
We will not be responsible for delay or non-performance caused by events outside our reasonable control.
This may include freight disruptions, supplier delays, severe weather, accidents, natural events, power or system failures, labour disruptions, government action, import delays or other circumstances that could not reasonably be avoided.
Where such an event affects your order, we will take reasonable steps to communicate with you and discuss available options where appropriate.
Privacy
We handle personal information in accordance with our Privacy Policy.
Our Privacy Policy explains how we collect, use, store and disclose personal information when you use our website, submit enquiries, place orders or interact with CDI.
